Article 1 – Definitions

In these terms and conditions, the following definitions apply: 

  • Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Ongoing Transaction: A distance contract concerning a series of products and/or services, with obligations spread over time.
  • Durable Data Carrier: Any tool that enables the consumer or entrepreneur to store information personally addressed to them in a way that allows future consultation and unchanged reproduction of the stored information.
  • Right of Withdrawal: The option for the consumer to cancel the distance contract within the cooling-off period.
  • Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.
  • Distance Contract: A contract concluded within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, where only one or more remote communication techniques are used until the conclusion of the contract.
  • Technology for Remote Communication: Any means that can be used to conclude a contract without the consumer and entrepreneur being physically present at the same time.
  • General Terms and Conditions: The present general terms and conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the general terms and conditions can be accessed and that they will be sent free of charge upon request.

If the distance contract is concluded electronically, the text of these general terms and conditions may be provided electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not possible, the consumer will be informed where they can access the terms electronically or receive them by other means free of charge.

If specific product or service conditions apply alongside these general terms, the second and third paragraphs apply accordingly. In case of conflicting conditions, the consumer can rely on the most favorable provision.

If one or more provisions in these terms and conditions are wholly or partially void or annulled, the contract and the remaining conditions remain valid, and the provision will be replaced by a new provision that most closely aligns with the original intent.

Situations not covered in these terms should be assessed according to the spirit of these terms. Any ambiguities should be interpreted in the most reasonable manner consistent with these general terms.


Article 4 – The Offer

  • If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
  • The offer is non-binding. The entrepreneur is entitled to modify or adjust the offer.
  • The offer includes a complete and accurate description of the products and/or services. The description is detailed enough to allow a proper assessment of the offer. If images are used, they are a true representation of the offered products and/or services.
  • Obvious errors or mistakes in the offer are not binding on the entrepreneur.
  • Each offer contains information that makes it clear to the consumer what rights and obligations are associated with acceptance of the offer, including:
    • The price, excluding import VAT and customs clearance fees, which are the responsibility of the customer.
    • Any applicable shipping costs.
    • The manner in which the contract will be concluded and what actions are required.
    • Whether the right of withdrawal applies.
    • The payment, delivery, and contract execution terms.
    • The acceptance period of the offer or the validity period of the price.

Article 5 – The Agreement

  • The contract is concluded when the consumer accepts the offer and meets the stated conditions.
  • If the consumer accepts the offer electronically, the entrepreneur will confirm receipt of the acceptance immediately. Until this confirmation is received, the consumer can dissolve the contract.
  • If the contract is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure electronic data transfer and ensure a safe web environment.

Article 6 – Right of Withdrawal

  • Consumers have the right to cancel the contract without stating a reason within 30 days after receiving the product.
  • During the cooling-off period, the consumer must handle the product and packaging with care. If they exercise their right of withdrawal, they must return the product in the original condition and packaging.
  • The consumer must notify the entrepreneur of their intention to withdraw within 30 days of receiving the product. After notification, the consumer must return the product within 14 days. The consumer must provide proof of timely return.
  • If the consumer does not notify the entrepreneur within the specified periods or does not return the product, the purchase is final.

Article 7 – Costs in Case of Withdrawal

  • If the consumer exercises their right of withdrawal, the return shipping costs are their responsibility.
  • If the consumer has already made a payment, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal, provided that the product has been received back in good condition.

Article 8 – Exclusions from Withdrawal

The entrepreneur may exclude certain products from the right of withdrawal if clearly stated in the offer. Exclusions apply to:

  • Custom-made or personalized products.
  • Perishable or time-sensitive goods.
  • Sealed hygiene products that have been opened.
  • Digital content not supplied on a tangible medium.

Article 9 – Pricing

  • The prices of the products and/or services offered will not be increased during the validity period stated in the offer, except for price changes due to VAT adjustments.
  • Import VAT and customs clearance fees may be charged by postal or courier services when the goods are imported into the EU country of destination.
  • All prices are subject to typographical and printing errors. No liability is accepted for such errors.

Article 10 – Compliance and Warranty

  • The entrepreneur guarantees that the products and/or services comply with the contract, the specifications stated in the offer, and reasonable usability requirements.
  • Any defects or incorrectly delivered products must be reported within 14 days of delivery.
  • The warranty does not apply if:
    • The consumer has repaired or modified the product themselves.
    • The product has been exposed to abnormal conditions or handled improperly.

Article 11 – Delivery and Execution

  • The entrepreneur will take the greatest possible care when receiving and executing product orders.
  • The address provided by the consumer is considered the delivery location.
  • If delivery is delayed, the consumer will be informed within 30 days. In this case, the consumer has the right to cancel the contract at no cost.

Article 12 – Complaints

  • Complaints about the performance of the contract must be submitted to the entrepreneur within 7 days after the consumer has identified the issues.
  • Complaints submitted to the entrepreneur will be responded to within 14 days.
